Can the US Marine corps own the exclusive copyright to historical flag designs?
I was just contacted by a distributor of my products (t-shirts) stating that the US Marine Corps claimed the copyright for a design I did featuring an adaptation of the famous Gonzales battle flag stating "COME AND TAKE IT"
As far as I understand, the USMC cannot own the copyright to the image as it is public domain. I cannot find any record of their owning the rights to this imagery anywhere.

I assume the Marines do have a copyrighted design that they are claiming your t-shirt infringes. You need to find out what that design is. I doubt the Marines are claiming copyright to the Gonzales battle flag. That just doesn't make sense.
